The Ministry of Economy and the Ministry of Health, through the General Directorate of Standards and the Federal Commission for the Protection against Sanitary Risks, based on articles 34 sections XIII and XXXI and 39 section XXI of the Organic Law of the Federal Public Administration; 4 of the Federal Law of Administrative Procedure; 3 section XXIV, 13 section A sections I, II and IX, 17 Bis section III and VI, 194, 195, 210, 212, 212, 213, 215, 216, 217 and 393 of the General Law of Health; 39 section V, 40 section XII, 47 section I of the Federal Law on Metrology and Standardization, 28 and 31 of the Regulation of the Federal Law on Metrology and Standardization; 25 of the Regulation of Sanitary Control of Products and Services; 19 sections I, XIV and XV of the Internal Regulation of the Ministry of Economy; 2 literal C section X of the Internal Regulation of the Ministry of Health and 3 section I subsection c and d and II and 10 sections IV and VIII of the Regulation of the Federal Commission for the Protection against Sanitary Risks, and

CONSIDERING

That it is the responsibility of the Federal Government to procure the necessary measures to guarantee that the products that are marketed in national territory comply with the commercial information that must be displayed on their label or packaging, in order to guarantee an effective protection of the consumer;

That on July 20, 2009, the National Consultative Committee for Standardization of User Safety, Commercial Information and Trade Practices (CCNNSUICPC) and the National Consultative Committee for Standardization of Regulation and Sanitary Promotion (CCNNNRFS), approved the publication of the Draft Mexican Official Standard PROY-NOM-051-SCFI/SSA1-2009, “General labeling specifications for prepackaged food and non-alcoholic beverages – Commercial and sanitary information”, which was published in the Official Gazette of the Federation on August 26, 2009, so that interested parties could submit their comments;

That the regulatory impact statement referred to in Article 45 of the Federal Law on Metrology and Standardization was submitted to the consideration of the Federal Commission for Regulatory Improvement, issuing the final approving opinion by said Commission on July 30, 2009.

That during the period of 60 calendar days from the date of publication of said draft Mexican Official Standard, the interested parties submitted comments on the content of said draft, which were analyzed by the CCNNSUICPC and the CCNNNRFS, making the appropriate modifications.

On February 4, 2010, the CCNNSUICPC and CCNNNRFS unanimously approved the referred standard;

That the Federal Law on Metrology and Standardization establishes that the Mexican official standards are the ideal instrument for the protection of consumer interests, issues the following:
